Divorce Records


Divorce records usually include the divorce proceedings, affidavits and judgments conditional and irrevocable. Some of them contain preliminary interrogations, documents on childcare, and copies of marriage certificates and photographs of the divorced couple.

The Archives do not maintain these records on the spot (must be a minimum of one day to recover). A certified copy of the irrevocable judgment is often sufficient as proof of legal divorce (for a remarriage, social assistance, a pension plan, a passport or citizenship). Step 1: How to order a divorce file; you need to know the file number. If you have this information, proceed to Step 2. The year in which the cause of divorce started: This information is available from the Registry of Divorce.

Give the office the approximate year of the divorce, and if you know, the dates of birth and the year of marriage. It will give you the case number and the year you need to retrieve the file. In other cases, depending on the date of the divorce, you can consult divorce directories. The etries in the directories are classified depending on the year, then depending on the first letter of surname, then depending on the exact date on which the judgment was granted irrevocable.

If you find the name of the couple, write:

      -     The file number and the year in which the cause of divorce began

  1. The date when the judgment was given irrevocable, then proceed to Step 2.

If you are do not find the name of the couple, maybe the divorce took place in other state. To determine if the couple filed a petition for divorce in a specific state, proceed to Step 3. If the divorce took place elsewhere search a research guide. The divorce files can be viewed in the Main Reading Room of the Archives. They are not kept on site and there must be a minimum of one working day to recover.

In the case of divorce cases that began between 1931 and June 1968: Fill out an application form for files and documents to obtain a record of action. Enter the file number, year and the names of the parties involved on the form and put it in a reference archivist, which will add information on the location of the file. In the case of divorce cases that began between July 1968 and 1978: Fill out an application form for files and documents to obtain a divorce petition. Enter the file number, year and the names of the parties involved in the formula. Do you need a certified copy of the file for divorce?

It takes five to seven days to recover, reproduce and certify such a document. The Archives must receive a payment before you can send a certified copy. A fee of photocopying may also apply.

Before 1985, the judgment was irrevocable document which gave it the divorce (this document is now called the certificate of divorce). If a request for irrevocable judgment has not been submitted or if the divorce records does not contain irrevocable judgment, it means that the divorce action had not been completed and that spouses can still be legally married. To confirm marital status of a couple, contact the Central Registry of divorce by phone or by fax.

If you cannot get to our main reading room, you can order copies of the entire file for divorce or specific documents from the file for divorce. Fill in the case number, year and the names of the parties to the divorce, and specify what documents should be copied and if you need a certified copy.

For each year, entries on the coil are ranked first according to the first letter of surname of the complainant (later, the names are placed in columns withdrawal whichever comes first vowel following the first letter of surname), then according to the file number. These folders contain all civil actions in the Superior Court (not just divorce), it is easy to identify the causes of divorce because, in most cases, the columns "Plaintiff" and "Defendant" (defendant) have the same family name.

In the case of divorce cases that began between June 1968 and 1978: Contact the Registry of Divorce by phone or by fax to confirm the filing of the case and to get the case number, the name of the county or district and the when the cause of divorce began.

Fill out an application form for files and documents to obtain a divorce petition (judicial district indexes to divorce petitions). Enter the year in which the divorce began on the formula. For each year, entries directories are classified according to the first letter of surname of the couple. If you find the file for divorce, take note of the file number and year.
